A young woman who was on a Ferris wheel when it was hit by a light aircraft has received $ 1. 5 million in damages from a New South Wales court that heard she was “unemployed” nearly 10 years after the traumatic event.

Amber Christine Arndell, then 13, and her brother were driving the 20-meter-high amusement park at the annual Old Bar Beach Festival near Taree in October 2011 when a two-seater light aircraft took off from an adjacent runway.

The NSW Supreme Court found this week that the MidCoast Council and pilot Paul Clarendon Cox were negligent for violating their care for the woman.

« [Arndell’s] evidence makes it clear that she was afraid the Ferris wheel would collapse and / or the fuel from the plane ignited – and that she and her brother would die, » Judge Stephen Rothman said this week.

He failed in his lawsuit against the council, despite the fact that the court accepted that the pilot suffered insomnia, flashbacks and other psychological damage as a result of the crash. His attempt to land, which turned into touch-and-go, « showed a lack of care and diligence, » said the judge.

The court heard that a council official had examined the ferris wheel after it was built and raised no problems with its placement. That was despite the fact that it penetrated the spreader – a three-dimensional area that should be left free for planes to land and take off.

Two medical experts agreed that Arndell’s experience with the collision was traumatic and had a significant impact, but disagreed as to whether the trauma had been resolved and what impact traumatic events had previously had on their perceived psychiatric illness.

The court heard that the woman rode another ferris wheel after the accident. She testified that this was under pressure from her grandparents to face their problems, and she trembled and cried as she did so.

Arndell was only able to visit the exhibition grounds in 2017, accompanied by her partner, and ride a Ferris wheel again.

The judge concluded that she had pre-existing psychological vulnerability, was going through a period of decompensation, and developed generalized anxiety disorder and major depression.

« The overwhelming cause of the plaintiff’s incapacity is the trauma associated with the collision, » he said.

Her school reports had spoken of a hardworking and confident student by the end of 2011, and it was not unreasonable to expect Arndell to graduate high school and work in the fashion industry, the judge said.

The collision had made this an « impossible task » and while it did not completely limit her enjoyment of life outside of work, it was « clear that the applicant is unemployed for all practical purposes, » the judge said.

Arndell, now 23, was awarded a little under $ 1. 1m for lost wages. Her non-economic loss was considered a payment of 412. Considered worth $ 200.
